1. Acceptance of Terms

By downloading, installing, or using NovaTheme ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

NovaTheme is a custom keyboard application for iOS that allows users to:

• Customize their keyboard with various themes, fonts, and styles.
• Create custom keyboard themes with personalized colors and settings.
• Test their typing speed with a built-in speed test feature.
• Adjust keyboard sounds, haptics, and other typing preferences.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. This license does not include the right to:

• Modify, reverse engineer, decompile, or disassemble the App.
• Distribute, sublicense, or make the App available to third parties.
• Use the App for any illegal or unauthorized purpose.
• Remove any copyright, trademark, or proprietary notices from the App.

4. User Content

You may create custom themes within the App. You retain ownership of any custom themes you create. However, you agree that:

• Custom themes are stored locally on your device.
• We are not responsible for any loss of custom themes due to device failure, app deletion, or software updates.

5. Intellectual Property

All rights, title, and interest in the App, including but not limited to its design, graphics, code, built-in themes, and fonts, are owned by NovaTheme and are protected by applicable intellectual property laws.

The fonts included in NovaTheme are open-source fonts licensed under the SIL Open Font License (OFL) or Apache License 2.0. These fonts are used in compliance with their respective licenses.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• The App will meet your specific requirements.
• Any defects in the App will be corrected.

7. Limitation of Liability

To the maximum extent permitted by applicable law, NovaTheme and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the App.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle your data (spoiler: we don't collect any).

9. App Store Terms

Your use of the App is also subject to the terms and conditions of the Apple App Store. In the event of any conflict between these Terms and the App Store terms, the App Store terms shall prevail with respect to your use of the App on Apple devices.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason. Upon termination, your right to use the App ceases immediately. You may also terminate these Terms at any time by deleting the App from your device.

11. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.
